Many foreign nationals who have completed their education in the United States are awaiting the H-1B random selection conducted by the USCIS and look forward to work in the United States utilizing their knowledge and skills. For the fiscal year 2021 H-1B, the initial electronic registration period will end at noon Eastern on March 20. To be considered for the initial selection process, all H-1B registrations must be submitted before noon Eastern on March 20. During the initial registration period, if USCIS receives enough registrations, USCIS then shall conduct a random selection. The number of selections would be based on the number of registrations projected, and needed to reach the FY 2021 H-1B numerical allocations. USCIS will then notify the selection via a user’s or the representing attorney’s online account. All selected registrants from the initial registration period will be notified no later than March 31, 2020. The notifications would notify the registrants that they are eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration. Then the period for filing the H-1B petitions that have been selected in the quota will run from 4/1/2020 through June 30, 2020, for at least 90 days. The H-1B cap-subject petitions must be properly filed within the filing period and when approved the foreign national will be eligible to work from October 1, 2020.
